A matrimonial property contract is concluded between spouses or persons just planning to marry, it has the effect of introducing a contractual matrimonial property regime and excluding the statutory regime. As a general rule, a statutory matrimonial property regime is created between the spouses upon marriage. By entering into a contractual matrimonial property regime the spouses may extend or limit the statutory community of property, introduce property division or property division with equalisation of assets.
